Parenting Time and Decision Making

Allocating parental responsibilities (aka child custody) is one of the most emotional and feared family law processes. Nothing is as important as the bond shared between parent and child.

Will I Lose My Children?

One of the biggest fears of parents who are getting a divorce is losing access to their children:

  • What if my ex-spouse tries to get full custody?
  • What if my ex-spouse tries to restrict my access to our children?
  • What are my chances of getting custody?
  • Are males less likely than females to get custody?


Before you let fear and emotions take over, it is important to understand the facts. Colorado family courts recognize the importance of both parents playing an active role in the life of a child. A 50-50 split in custody is not presumed to be the best approach, as each case is considered on its own merits, but this is often understood as a starting point.


And while in the past mothers were often presumed to be the best suited for full physical custody, this is no longer the case. The courts recognize that fathers, just as mothers, deserve to play an important role in the life of the child. While there are many horror stories and urban legends, the fact is, fathers who want to be in their children’s lives are almost always permitted to do so.
